Rather than limiting my involvement to closing documentation, I remained engaged when loans encountered difficulties. Delinquencies, covenant violations, disputed balances, refinancing proposals, workouts, and enforcement questions required analysis of the lender’s contractual rights alongside commercially realistic recovery options. I also advised on internal lending practices, confidentiality, financial disclosures, regulatory considerations, and relationships with borrowers, investors, brokers, and other transaction participants. This combination of transactional and enforcement work allowed Mortgage Tree Capital to approach financing opportunities with stronger documentation, clearer remedies, and better protected capital.
